1. IntroductionWelcome to Elias Services Ltd, trading as Futurebound (“Futurebound”, “we”, “us”, “our”).
These Terms and Conditions govern your access to and use of all Futurebound services, including memberships, subscriptions, online education, coaching, workshops, live events, tools, digital resources, and communications.
By accessing, purchasing, or using any Futurebound service, you agree to be bound by these Terms. If you do not agree, you must not access or use our services.
These Terms apply to all Futurebound services unless otherwise stated at the point of purchase.
2. DefinitionsServices means all memberships, subscriptions, online courses, coaching, workshops, live events, tools, resources, and communications provided by Futurebound.
- Member / Participant / User means any individual who accesses or purchases our Services.
- Subscription means a recurring payment arrangement billed at regular intervals until cancelled.
- Rules of Engagement means product-specific terms, guidelines, or participation rules applicable to a particular Service.
- Third-Party Provider means any external business or professional not operated by Futurebound.
3. Nature of Services (Important)Futurebound provides financial education, tools, systems, and coaching support only.
We do not:
- Provide personalised financial advice
- Act as licensed financial advisers
- Provide regulated financial services under the Financial Markets Conduct Act 2013
All information provided is general in nature and educational only. You remain solely responsible for your financial decisions and outcomes. You should seek independent advice from a licensed financial adviser, accountant, or lawyer where appropriate.
4. User ObligationsYou agree to:
- Provide accurate and complete information
- Use the Services for personal use only
- Keep login details secure and confidential
- Not share, resell, or redistribute access or content
- Comply with all applicable Rules of Engagement
We reserve the right to suspend or terminate access where misuse, sharing, or breach occurs.
5. Fees, Payments & Subscriptions5.1 General
Fees are disclosed at the time of purchase. By completing payment, you authorise Futurebound to charge the applicable fees using the payment method provided.
All prices are in New Zealand dollars unless stated otherwise.
5.2 Subscriptions
Where a Service is offered as a subscription:
- Payments are charged automatically at the agreed interval
- Subscriptions continue until cancelled by you
- Cancellation takes effect at the end of the current billing period unless otherwise stated
- Access continues until the end of the paid period
Subscription-specific terms, including cancellation instructions, may be outlined at checkout or in the applicable Rules of Engagement.
5.3 Payment Plans
Payment plans may be offered as a convenience and do not reduce the total price unless expressly stated.
If a payment fails:
- Access may be paused or cancelled
- Outstanding balances remain payable
Failure to complete a payment plan does not entitle you to a refund.
5.4 Pricing ChangesWe may change pricing for subscriptions or Services from time to time. Any changes will:
Be communicated in advance where required
Apply from the next billing cycle
6. Refunds, Guarantees & Cooling-OffDue to the digital and educational nature of our Services:
- No cooling-off period applies unless expressly stated at the point of purchase
- Change of mind does not entitle you to a refund
- Where a refund or money-back guarantee is offered:
- It applies only to the specific Service stated
- All conditions must be met in full
Eligibility, timeframes, and processes will be set out in the applicable Rules of Engagement or Guarantee Policy
7. Memberships & Rules of EngagementCertain Services operate as memberships with ongoing access and support.
Each membership may have specific Rules of Engagement covering matters such as:
- Access and participation
- Community behaviour
- Cancellations
- Guarantees
- Use of tools and resources
These Rules form part of these Terms and are incorporated by reference.
8. Coaching, Programs & Events Participation in coaching, programs, or events does not guarantee any specific financial or personal outcome.
Results depend on individual circumstances, engagement, and implementation.
We reserve the right to:
- Reschedule or cancel sessions where required
- Substitute facilitators where necessary
8.1 One-on-one Sessions & Session Packages
Where a Service includes one-on-one coaching, strategy sessions, or similar individual sessions:
Access to book and use one-on-one sessions is conditional on the Member holding a current and active subscription or payment plan where required.
If a Member does not have a current subscription or active payment plan:
Any unused sessions will be placed on hold, not forfeited
Sessions may be resumed once the required subscription or payment plan is reactivated
All sessions remain subject to the original expiry date
Unused sessions that reach their expiry date will lapse and are not refundable unless expressly stated otherwise.
9. Community Participation & ConductWhere Services include community spaces or group participation:
- Respectful behaviour is required
- Harassment, abuse, or disruption will not be tolerated
We reserve the right to moderate, remove content, or revoke access to community spaces at our discretion.
10. Referrals to Third-Party ProvidersWe may introduce or refer you to Third-Party Providers.
Futurebound:
- Does not control their services
- Is not responsible for their advice, actions, or outcomes
Any engagement with Third-Party Providers is at your own discretion and risk.
11. Intellectual PropertyAll content, systems, tools, frameworks, and materials are owned by Futurebound or licensed to us.
You may not copy, reproduce, distribute, or commercialise any content without prior written permission.
12. ConfidentialityYou agree to maintain the confidentiality of:
- Other participants
- Group discussions
- Proprietary processes and materials
13. Limitation of LiabilityTo the fullest extent permitted by New Zealand law:
- We are not liable for decisions or actions you take
- We do not guarantee outcomes
Our total liability is limited to the amount paid by you for the relevant Service
Nothing in these Terms limits rights under the Consumer Guarantees Act 1993 where applicable.
14. PrivacyWe collect, use, and store personal information in accordance with the Privacy Act 2020.
Our Privacy Policy explains how your information is handled and forms part of these Terms.
15. Force MajeureWe are not liable for failure or delay in performance due to events beyond our reasonable control, including illness, platform outages, natural disasters, or government restrictions.
16. AssignmentWe may assign or transfer our rights and obligations under these Terms as part of a business restructure, sale, or transfer.
17. TerminationWe may suspend or terminate access to Services where these Terms are breached.
Termination does not affect any payment obligations already incurred.
18. Governing LawThese Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of New Zealand courts.
19. Changes to TermsWe may update these Terms from time to time. Material changes will be communicated via email or our website.
